It was pointed out to me by another (non-pirate) player that this
would make fighting npc pirate ships very difficult. His solution
was to set flag on the target ship only if damage is done, so if
I'm sailing along and I get:
Wedgeantilles tells you 'Tha Spectral Sailor fired cannons in our general
direction.'
Then no flag on my ship would be given, however if they manage to
hit the ship with an attack, then flag could be set.
